Photo Submission Terms

Eligibility and acceptance

You must be at least 18 years old to submit. By uploading, you agree to these Photo Submission Terms and acknowledge the Privacy Policy. If you do not agree, do not upload.

Your promises

For every photo you submit, you represent and warrant that:

• you took the photo, own the necessary rights, or have permission from the rights owner;
• you have permission from every recognizable person to submit and permit the uses described here;
• for every recognizable person under 18, you are that person’s parent or legal guardian or have permission from the parent or legal guardian;
• the photo does not violate anyone’s copyright, trademark, privacy, publicity, contractual, or other rights; and
• the photo and caption are truthful, lawful, and do not contain prohibited content.

License you grant Moutardier

You keep ownership of your photo. You grant Moutardier Resort + Marina a non-exclusive, worldwide, royalty-free license to review, store, reproduce, crop, resize, edit for presentation, caption, display, publish, distribute, and otherwise use the submitted photo and accompanying caption or credit for Moutardier’s website, social media, email, advertising, marketing, public relations, signage, brochures, and other digital or printed promotional materials.

Moutardier may allow its contractors, printers, advertising partners, social platforms, and service providers to exercise these rights only as reasonably needed for those Moutardier uses. No payment or other compensation is owed. Moutardier is not required to use, credit, or return a submission.

People shown and publicity permission

To the extent permitted by law, you authorize the use of the name, image, likeness, and appearance of you and the people for whom you are authorized to consent, as they appear in the submitted photo, in connection with the licensed Moutardier uses. Do not submit a photo if any recognizable person has not agreed.

Requesting future removal

You may ask Moutardier to stop new uses of a photo by emailing Noelle@MoutardierNolin.com. Include the submission confirmation number when possible. We will make reasonable efforts to stop future uses after confirming the request, but we may not be able to recall printed materials already produced, posts already shared by others, archived materials, or content already distributed before the request.

Prohibited submissions

Do not submit intimate or sexual content; nudity; violence or dangerous activity; harassment, hate, threats, or illegal conduct; confidential documents; visible financial, medical, or identifying records; advertising or spam; malicious files; or content that exploits a child or violates another person’s rights. Moutardier may reject, remove, preserve, or report content when reasonably necessary for safety or law.

Review, availability, and disclaimer

Moutardier decides whether, where, and how an eligible photo is used and may remove it at any time. The upload service is provided on an “as available” basis. To the fullest extent permitted by law, Moutardier disclaims implied warranties relating to uninterrupted availability or selection of a submission. Nothing in these terms limits rights or liabilities that cannot legally be limited.

Governing law and contact

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. If part of these terms is unenforceable, the remaining terms continue to apply.
